Hubino Terms Of Use.....
Introduction
The terms 'Hubino' and 'Hubino.com' are used in this document (or Agreement) to refer to the Web site itself and to Hubino, the company which owns and operates the Hubino website.
Hubino.com, or Hubino, is an online website that provides innovative services to its members. This document covers the terms and conditions under which these services are provided and the privacy policy of the site.
Your registration as a member of Hubino or the use of any of the features and services on Hubino either as a registered member or as an unregistered visitor constitutes acceptance of these terms and conditions and the privacy policy defined herein. Terms of Service
Hubino is a service provider as we do not control the truth or accuracy of content posted or the safety, or legality of the items advertised or sold. You may find other users' information or advertisements posted to be offensive, harmful, inaccurate or deceptive. The views expressed on the website are not those of Hubino.com, and any errors or omissions in them belong to the respective contributors / copyright holders. Through the use of this site, you agree to hold harmless Hubino and its sponsors, owners, shareholders or employees against any and all claims related to the opinions expressed by others.
The remainder of this document covers the specific terms and conditions under which each major service category of Hubino are provided for your use. It is your responsibility to make sure you read and understand this document before using any Hubino service. Accessing and Transmitting Hubino Content

Contributing Content to Hubino
Hubino provides value to its contributors by making available to them its vast global audience reach.

All such information is referred to below as the "Content".

You truthfully assert that the content being contributed is your creation and that you own the copyright to the content. Unless you have deliberately assigned the copyright to someone else, you automatically own the copyright to all of your original creations.

In case the contributions are digital images of artwork in traditional media such as canvas, that is available for sale, you may also publish digital images of your artwork on commercial Web sites that sell art online, only for the purpose of sale.
Once granted and your content is published, the distribution rights cannot be revoked. In other words, once your contribution is published on Hubino it automatically becomes a permanent part of the publicly-accessible Hubino archives. You may, however, subject to our approval, update or revise your contributions on Hubino.
You will not receive any monetary compensation for your submissions. The only in-kind compensation we promise is exposure on the World Wide Web and a home for your expression on the web.
You grant us the right to organize, categorize, collate your contributed content and present it on the website in any manner we see fit. We may remove or edit your contribution at our discretion without having to secure your permission. We will however make reasonable efforts to inform you of the changes.
We generally do not object to our contributors posting their Hubino contributions on other, freely accessible non-commercial Internet locations, so long as Hubino is clearly cited as the original publisher, and a link to www.Hubino.com is provided. You, however, agree to secure our permission first before such re-publication on other Internet sites happens.
You agree to state Hubino.com as the previous publisher prominently in case you print your article in an offline magazine.

Disrupt the normal flow of dialog by repeatedly posting the same or similar material, or otherwise acting in a manner that negatively affects other users' ability to engage in exchanges;
"Stalk" or otherwise harass another user; Collect or store personal data about other users either manually or by means of automated software tools; Promote illegal activities; Inhibit other users from using and enjoying the unedited forums.
Post classifieds advertisements that contain untruthful representations, deceptive practices, inducements to commit any illegal activity.
Using Hubino Services
This Section covers the terms under which various Hubino services, including, but not limited to, link any information available on Hubino, are made available to you.
You agree that:
Hubino may electronically block or otherwise deny access to the Hubino Web site, to any user deemed to be in violation of any of the terms in this document.
Hubino is not obliged to ensure that the Web site is available to all users at all times. While we make all attempts to deny access only to those individuals who violate Hubino regulations, we are occasionally forced to use access denial methods that cause a disruption in access for other users.
Hubino is not responsible for a loss of access to Hubino services due to failure of networks connected to the Internet, or any other temporary hardware or software failure.
Hubino reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Using Hubino Classifieds or Marketplace Services
Hubino provides Hubino Classifieds as a service to enable its users to connect with one another. Hubino provides the platform but does not directly participate in, nor is it involved in any Classifieds transactions. Please keep in mind that Classifieds are posted not by Hubino, but users of Hubino. Users of this service are responsible for all aspects of the transactions in which they choose to participate. Hubino requires a user to register and accept the terms of Hubino before posting a classifieds ad but does not screen or control users who may sell or buy on Classifieds, nor does Hubino review or authenticate all listings, items, or services offered for sale. Hubino have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. Therefore, users of this service should be aware that:
Sellers and buyers are completely responsible for working out the sale and exchange of goods or services. They must resolve any disputes that may arise in their dealings.
Sellers and buyers are responsible for researching and complying with all applicable laws, regulations or restrictions on items, services, or manner of sale or exchange that may pertain to transactions in which they participate.
Sellers and buyers are responsible for all applicable taxes and for all costs incurred by participating in Hubino Classifieds.
Hubino will not be liable for any damages of any kind incurred as a result of the information contained in the Hubino Classifieds or the use of Hubino Classifieds
Users may not use or manipulate this service for any fraudulent activity or purpose. Items or services offered for sale must comply with all applicable laws of our land such as contracts.
Hubino may take action to delete the classifieds ads and/or Hubino user accounts that we believe are misusing this service. Prohibited spam or otherwise impermissible marketing activities in Hubino
Classifieds may include, but are not limited to, the following:
Posting an ad that is unrelated to the category in which the ad is placed.
Posting an ad with inappropriate links, titles, descriptions, or unauthorized use of content to which the person posting does not have rights.
Posting an ad through unauthorized robots (crawling software).
Soliciting a Hubino Classifieds user to post an ad in another classifieds site.
Posting ads for services that compete with any of Hubino's services.
Posting ads for ad typist or home typist.
Because Hubino is a platform, in the event that users have disputes Hubino and its employees, officers, agents and directors are released from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. We do not control the information provided by other users that is made available through our system. Users may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution and common sense for your own safety. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals.
Member Registration
Hubino requires registration for those who participate in a variety of its services. When you register as a Hubino member, you accept the following terms and conditions:
You agree to provide true, accurate, current and complete information as required in the registration form.
You agree maintain and promptly update the Registration Data as necessary to keep it true, accurate, current and complete.
If, after investigation, Hubino has reasonable grounds to suspect that any user's information is untrue, inaccurate, not current or incomplete, Hubino may suspend or terminate that user's account and prohibit any and all current or future use of the Hubino Sites (or any portion thereof) by that user other than as expressly provided herein.
Each user is wholly responsible for maintaining the confidentiality of account login and password information and for all activities occurring there under. Hubino cannot and will not be liable for any loss or damage arising from a user's failure to comply with this Section 4, including any loss or damage arising from any user's failure to: (1) immediately notify Hubino of any unauthorized use of his or her password or account or any other breach of security; and (2) ensure that he or she exits from his or her account at the end of each session.
You agree that Hubino reserves the right to publish any and all information provided as part of Hubino registration, except email address and password to authenticate the user, to facilitate social networking among its members.
Termination for Bankruptcy or Insolvency : If Hubino is either informed or comes to know through other sources that a customer becomes insolvent or any bankruptcy petition is filed by the customer, or any third party against the customer, Hubino may immediately terminate provision of Hubino's services to the customer without prior notice or penalty. Such customer consents to the grant of relief from any automatic stay of proceedings against Hubino in such event.
You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.
Disclaimer of Warranties and Indemnity
YOUR USE OF HUBINO IS AT YOUR OWN RISK. THIS WEBSITE IS PROVIDED BY HUBINO. ON AN "AS IS" AND "AS AVAILABLE" BASIS. Termination
Hubino Solution reserves the right to discontinue in whole or in part any portion of Hubino services or programs with or without notice.

However, when Hubino becomes aware of any violation of the terms or other user agreements, Hubino may take any action to stop or correct such violation, including denying access to Hubino?s services. In addition, Hubino may take action against a customer or a customer of such customer because of the activities of such customer. Hubino anticipates that customers who offer Internet services will cooperate with Hubino in any corrective or preventive action that Hubino deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of Hubino policy and Hubino reserves the right to take any such action even though such action may affect other customers of the Hubino customer.
Hubino and its , affiliates and associates shall not be liable, at any time for damages (including, without limitation, damages for loss of business projects, or loss of profits) arising in contract, tort or otherwise from the use of or inability to use the Service, or any of its contents, or from any action taken (or refrained from being taken) as a result of using the Service or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorised access to, alteration of, or use of information contained on the service. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT MEMBER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS USER AGREEMENT. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN HUBINO OR ITS PROGRAMS AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENTS OTHER THAN AS SET FORTH IN THIS AGREEMENT.
General legal terms :
Sometimes when you use the Services, you may (as a result of, or through your use of the Services) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms do not affect your legal relationship with these other companies or individuals.
The Terms constitute the whole legal agreement between you and Hubino and govern your use of the Services (but excluding any services which Hubino may provide to you under a separate written agreement), and completely replace any prior agreements between you and Hubino in relation to the Services.
You agree that Hubino may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services.
You agree that if Hubino does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Hubino has the benefit of under any applicable law), this will not be taken to be a formal waiver of Hubino's rights and that those rights or remedies will still be available to Hubino.
If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
You acknowledge and agree that each member of the group of companies of which Hubino is the parent shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favor of) them. Other than this, no other person or company shall be third party beneficiaries to the Terms.
In case of any disputes you agree to initiate arbitration/conciliation proceedings within the jurisdiction of Chennai by a common arbitrator acceptable by Hubino before initiating any other legal proceedings before any court of law within the jurisdiction of Chennai.
The Terms, and your relationship with Hubino under the Terms, shall be governed by the laws of the Government of India without regard to its conflict of laws provisions. You and Hubino agree to submit to the exclusive jurisdiction of the courts located within the jurisdiction of Madras to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Hubino shall still be allowed to apply for legal remedies in any jurisdiction.
